Senate Bill 610 – Section 1003.455, Florida Statutes

The implementation of Senate Bill 610 went into effect during the 2009-2010 academic year. This legislation included statute 1003.455, F.S., which mandated that students in grades 6 - 8 are required to take the equivalence of one (1) semester of physical education in grades 6, 7, and 8. In addition, the statute established criteria for exemption through the following waiver process.

  • The student is enrolled or required to enroll in a remedial course
This refers to students that are enrolled in remedial reading and/or mathematics courses. A Programming Sheet or physical education waiver with parent signature must be maintained on file at the school for students enrolled in a remedial reading and/or mathematics courses. Students are not to be assigned to more than one (1) period of physical education per instructional day.

  • The parent requests a physical education waiver in writing to the school
The State requires that students take the equivalence of one (1) semester of physical education in grades 6, 7, and 8. This requirement may be met through regular physical education class, FLVS physical education or physical activities outside the school day which are equal to or in excess of the mandated requirement.

Physical activities outside of the school day that meet the requirement are those that the parent indicates in writing are equivalent to 250 minutes per week for a minimum of eighteen (18) weeks during the designated semester. This option is intended as an opportunity for students to enroll in an elective course or accelerated course in place of the physical education course. It is NOT intended as an option for early dismissal. The expectation is that students are enrolled in classes for seven (7) periods per instructional day. A physical education waiver request form is required.
